We are thrilled that you have chosen Safe Step, a subsidiary of Ferguson Enterprises, LLC, for your bathroom needs. Safe Step has chosen as a corporate matter to adopt these Terms of Sale. Where you are purchasing from Safe Step, any and all references herein to Ferguson shall mean Safe Step. Any purchases made by you through Safe Step constitute your unconditional agreement to follow and be bound by these Terms of Sale. These Terms of Sale, together with the Terms of Use, and any other policies, rules and provisions linked or otherwise referred to herein, including, without limitation, our Privacy Policy, constitutes the entire agreement between you (“you” or “your”) and Safe Step, a subsidiary of Ferguson Enterprises, LLC, or the respective subsidiary (“Ferguson,” “we,” “us,” or “our”), superseding any and all prior or inconsistent understandings, representations or agreements regarding your purchase(s) through a Ferguson Site.
We reserve the right to update or modify these Terms of Sale at any time without prior notice. Your purchase from Safe Step following any such change constitutes your unconditional agreement to follow and be bound by the Terms of Sale as changed. For this reason, we encourage you to review these Terms of Sale prior to making any purchase.
Shipping
Due to the variety of products we sell, shipping types and costs may vary. Please check Safesteptub.com to find shipping information for specific products. We understand that getting your items in a timely manner is important. We make commercially reasonable efforts to ship your purchases to you as quickly as we are able. However, situations may arise that we cannot control, and which may affect shipping times. Safe Step has no responsibility for delays in shipping caused by a force majeure event including, but not limited to, acts of God, war, labor disputes, civil unrest, changes in the law affecting the import or export of goods, accidents, pandemics, the inability to obtain materials or goods, delays of carriers, contractors or suppliers, or any other causes beyond our control. If you cause or request a delay of shipment, or if Ferguson ships or delivers an order erroneously as a result of inaccurate, incomplete, false or misleading information supplied by you, Ferguson reserves the right to charge any additional shipping and/or storage costs to you.
Shipping Destinations and Delivery Restrictions
Generally, Safe Step is able to ship to most addresses (excluding PO boxes) within the United States and Canada, subject to some restrictions. Some states may have delivery restrictions, which are noted on the specific product page or on the applicable Safe Step. In addition, certain shipping types may not be available to particular states, such as Alaska, or address types (e.g. APO/FPO addresses).
Due to variances in tax laws from state to state, once an order has been placed, we are not able to alter the shipping address. Please make sure that all of your shipping information is correct before placing your order. Ferguson reserves the right to cancel your order if we have reason to believe you have provided a false address in an attempt to evade state sales tax. Backordered Products
Occasionally, an item is out of stock and is on backorder. We will endeavor to notify you promptly if an item is on backorder, and provide available options, which may include cancellation, selection of alternate products, or shipping the backordered product once it becomes available.
You may still be able to place orders for backordered items, if desired, in order to reserve the item with the manufacturer. Please note that you will be charged for the items in accordance with our payment policy, as you would for any other item that is not on backorder.
Cancellations and Returns
Cancellations
Since we do everything, we can ship your order as soon as possible, there is a very short period in which an order can be cancelled or modified. Once an order has shipped, or in the case of special-order items, once the order has been placed with the manufacturer, it can no longer be canceled. Returns
Please note that some products are not eligible for return or may require an authorization before they can be returned. If the goods are returned and do not meet these requirements, we reserve the right to reject the return, or to deduct additional fees from your refund. Returns may be subject to a re-stocking fee, or shipping fees, which will be deducted from any refund. We may accept the return of some special orders or non-stock goods at our discretion, and if the manufacturer is willing to accept the return. Any restocking or cancellation fees charged to Safe Step by the manufacturer and/or vendor may be deducted from your refund. Clearance; liquidation or close-out items; furniture; if applicable, are not returnable.
You may be able to return damaged or defective items for a refund or replacement, provided that you follow the return policy In addition, one of the following must apply: (i) the item has a defect that hinders its usability for the purpose for which it was designed; (ii) the incorrect item was received, or the item is missing parts; or (iii) the item was damaged in transit. Please note that not all items are eligible for return, as outlined in the Returns section above, and some defective items may only be eligible for repair or replacement at the manufacturer’s discretion.
You must inspect all goods upon delivery. If there is obvious damage, do not sign for or take possession of the item. Immediately contact our Customer Service team via Live Chat at safesteptub.com or email CustomerCare@safestetub.com so we can help you process a claim with the carrier and arrange for a replacement. If you accept delivery, but notice damage during unpacking, you must provide pictures of the damaged box and/or product. For all damaged products you must contact us within 48 hours of receipt, as carriers only allow 2 business days to file a freight claim. Otherwise, you may be responsible for filing a freight claim, or arranging the return or repair of the goods.
Pricing and Payment
For your convenience, you will be charged upon placing your order through Safe Step and your order will be shipped.
Unfortunately, we do not offer any additional discounts beyond any then-current deals or other specials, which are publicized on the applicable Ferguson Site. All taxes, transportation costs, duties and other charges are in addition to listed prices. Where possible, the amount of any sales, excise or other taxes applicable to your purchase will be added to the purchase price at checkout. Please note that for Canadian customer purchases, you will be responsible for all customs duties, which may be charged at the time of purchase, or later if they cannot be calculated at the time of purchase. Any other potential international shipments, please refer to the Compliance with Export Controls Law section below. If you believe there has been a billing error, you must notify us by email CustomerCare@safesteptub.com or by mail to 520 Royal Parkway Suite 100 Nashville, TN 37076 within ten (10) business days from the date you are charged. Claims not received within such time are hereby waived.
Pricing Information
While Safe Step strives to provide accurate product and pricing information, pricing or typographical errors may occur. The Ferguson Sites cannot confirm the price of any item until after you order. In the event an item is listed at an incorrect price or with incorrect information due to an error in pricing or product information, the Ferguson Sites shall have the right, at our sole discretion, to either contact you for instructions or cancel your order and notify you of such cancellation. Prices and availability are subject to change without notice.
Order Acceptance
We reserve the right, in our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is canceled, or if additional information is required to accept your order. If your order is canceled after payment is received, we will issue a full refund to the payment method used for the purchase.
Quantity Limits
We reserve the right to limit the quantity of items purchased per person, per household or per order. We will notify you in the event such limits are applied. We also reserve the right to prohibit sales to
dealers. If you are interested in purchasing items for a corporation or institution, please contact our (Customer Service team via Live Chat at SafeStepTub.com, by emailing customercare@safesteptub.com. Any promotions, special purchases, open box items, or dealer seconds, if available through a Ferguson site, are only valid while supplies last. In the event these special items are "oversold," a full refund will be issued.
Product Descriptions
The Safe Step site attempts to be as accurate as possible. However, Ferguson does not warrant that product descriptions or other content on any Ferguson Site is accurate, complete, reliable, current, or error-free.
The Ferguson Sites have also tried to display as accurately as possible the colors and finishes of products that appear on the Ferguson Sites. However, the actual colors you see will depend on your monitor. Therefore, we cannot guarantee that your monitor's display of any color or finish will be accurate. If a product you purchase from us is not as described, or you are dissatisfied with the color and finish upon receipt, you may return it as your sole and exclusive remedy, subject to our Return Policy. Please note that some items are not eligible for return, so please review carefully before making your purchase.
